Deciding Hari Dutta Sharma v. State of Uttar Pradesh, a Bench of Justice P.S. Narasimha and Justice Alok Aradhe held that the RBI's recovery guidelines "have existed only on paper" and directed the central bank to secure genuine compliance by banks and NBFCs alike.

Recovery agents seized the borrower's truck at about 1 a.m. on 9 April 2023 in Ayodhya, breaking the steering lock; it was sold for ₹4.50 lakh on 31 August 2023 without proper notice.
Relief: refund of ₹4,50,000 with 6% interest, compensation of ₹10,00,000 for mental agony and loss of livelihood, ₹50,000 costs, and closure of both loan accounts.
The Court invoked Article 21 (right to livelihood) and Article 14 (arbitrariness), and relied on Section 35-A of the Banking Regulation Act, 1949.
